Family Court has due process issues across the nation. I hear all the time litigants say, "...once the Judge hears this...." or "...once I have my day in court, then the Judge will know and I will get justice." They don't realize they are playing Russian roulette. The reality is most Family Courts are unsafe spaces for families. This is not a place you want to be in long term for either party because at any given time, you can lose your rights without even being heard. It is not an end all but rather a continuing cycle of pain and sorrow. You have to be wise and knowledgable in the Family court system especially if you are dealing with an opposing party that is unsafe.
The legal industry is facing a decline in utilization in Family Courts. Due to the actions of many court actors and the extreme costs to maintain legal representation, families have decided to handle this on their own.
This demand is so great that states are now considering training paraprofessionals and paralegals to get licensed to assist families in Family Courts. The thing is most couples can navigate Family Court ambicable and resolve their issues once they know the steps to get it done and they are doing that on their own. The issue that will be a struggle will be for the couples who do not get along, have communication issues, and/or an abusive unhealthy relationship. Family Courts take advantage of these types of litigants. You have to be very aware of how to maneuver within such a system or even identify the system you are in.
