While many people initially turn to the U.S. court systems for everything specifically as their primary route for resolution, there are many effective alternatives available. This post will highlight several non-court solutions that individuals can consider to manage divorce and child custody matters more peacefully.

Mediation: A Collaborative Approach


If you have followed us at anytime, you know that we believe in Mediation for everyone. Mediation is one of the most popular alternatives to court proceedings. In this process, a neutral mediator assist in conversation between both parties to help them reach an agreement without needing a judge's involvement.


Consider a situation where parents disagree about holiday visitation schedules. In mediation, they can discuss their preferences openly and collaboratively, potentially agreeing to a flexible arrangement that allows both parents to spend quality time with the children during the holidays. Even if the parents are parallel parenting, or there is a need for limited engagement with the other parent then a mediator is a great go between to resolve those issues.


Mediation tends to be quicker and less expensive than going to court. Studies show that mediation can reduce overall conflict and lead to better parenting relationships. Additionally, many states require mediation before moving forward with court proceedings, underscoring its importance in resolving disputes. There is a difference between court mediations and private mediation. But overall this is a great resource that we can assist you with if interested.


Collaborative Divorce: Working Together


Collaborative divorce is another effective non-court option focusing on teamwork. In this alternative, each partner hires their attorney, but they commit to resolving issues amicably. This process often includes professionals like financial advisors and child specialists, who provide expert guidance to help the couple settle their disputes. The attorneys who normally complete this type of resolution are called "Collaborative attorneys".


For example, if a couple has complex financial situations involving multiple properties, collaborative divorce allows their financial advisors to work together, ensuring that all aspects are fairly considered without the tension of court battles. This approach frequently leads to better outcomes for everyone, especially the children, who benefit from a healthier family dynamic. This structure is not for everyone, but if the parents are able to be amicable then this structure may be a good fit for you.


This alternative is just as expensive as utilizing the court system. It can range per partner anywhere from $10,000+ but it ensures that the partners have full discretion over our lives instead of leaving it in the hands of the government.


Arbitration: A Private Resolution


Arbitration, while less common, is a valuable alternative to court. This is the most underrated resource for people who are in need of a ruling or judgment. In this scenario, a neutral arbitrator reviews both sides of the dispute and makes a binding decision. The arbitration process is usually faster and more private than traditional court battles. In addition, it can be used collaboratively with mediation. You can attempt mediation first, and anything that is not agreed in mediation can be then addressed in arbitration.


This approach can be beneficial in self-representing yourself and if you would like to pick and choose an Arbitrator that is knowledgeable or an expert. For example, most court Judges are not experts about children, many Judges are not even parents. So they are making decisions on not what they know personally or by expertise but rather about how they feel. Instead you can use Arbitrators that you choose and it can be one, three, or five.


This does cost, and depends on how many Arbitrators you decide to utilize, but you can present your own case, you do not need an attorney, and you choose who is making a determination of your situation. The rulings are binding just as a Judges ruling.
